Privacy Policy
Kreative Brands LLC ("Kreative Brands," "we," "us," or "our") respects your privacy. This Privacy Policy explains what personal information we collect, how we use, store, and share it, how long we keep it, how we protect it, and the choices and rights you have. It applies to thekreativebrands.com and its subpages (the "Site"), to inquiries you submit through the Site, and to email, phone, and text communications with us that result from those inquiries.
1. Who We Are
Kreative Brands LLC provides sales, marketing, customer support, fulfillment, website, and white label services for a portfolio of brands. We are the controller of personal information collected through the Site. Where we handle customer information on behalf of a brand, we act as that brand's service provider or processor, and that brand's own privacy policy also applies. Contact details are in Section 15.
2. Information We Collect
Information you give us. When you submit a contact form or contact us directly, we collect:
- Identifiers and contact information: first and last name, email address, company or brand name, and phone number (if you provide it or contact us by phone or text).
- Inquiry details: the service you are interested in and the message you choose to write.
- Communications: the content of emails, calls, text messages, and chat messages you send us, and our replies.
- SMS consent records: when you opt in to text messages, the date, time, and form through which you consented.
Information collected automatically. When you visit the Site, our hosting provider and embedded services may receive your IP address, approximate location derived from IP address, browser and device type, operating system, referring URL, pages viewed, and timestamps.
Information we do not seek. We do not ask for Social Security numbers, bank account numbers, government ID numbers, or payment card details through the Site. Please do not include them in a form or message. We do not knowingly collect precise geolocation or biometric data.
3. How We Use Your Information
- To respond to your inquiry and evaluate potential business relationships.
- To send text messages and emails you have asked for or consented to (see Section 7).
- To operate, secure, and maintain the Site, detect spam and abuse, and troubleshoot problems.
- To understand how the Site is used and improve it.
- To keep business records and comply with legal, regulatory, tax, and accounting obligations.
- To establish, exercise, or defend legal claims.
We do not use your information for automated decision-making that produces legal or similarly significant effects on you.
4. Legal Bases (EEA, UK, and Similar Jurisdictions)
Where laws such as the GDPR apply, we process personal information based on: your consent (for example, text messaging, which you may withdraw at any time); our legitimate interests in responding to inquiries, running and securing the Site, and developing our business, balanced against your rights; steps taken at your request before entering into a contract; and compliance with legal obligations.
5. How We Share Information
We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We disclose information only as follows:
- Service providers. Vendors that process data on our behalf under confidentiality and data-protection obligations. Currently these include: Vercel (Site hosting and delivery); Formspree (processing and delivering contact form submissions to us); and customer relationship management, email, and text messaging providers used to communicate with you. Vendors may change over time, and we will keep this list current.
- Brands on our platform. If your inquiry concerns a specific brand, we share it with that brand so it can respond.
- Professional advisers. Attorneys, accountants, and other advisers bound by duties of confidentiality.
- Affiliates. Our affiliate Majors Hunter Group, if you ask about selling or partnering your brand.
- Legal and safety. When required by law, subpoena, or legal process, or to protect the rights, property, or safety of Kreative Brands, our users, or others.
- Business transfers. In connection with a merger, financing, acquisition, or sale of assets, subject to equivalent privacy protections.
- With your direction. Any other disclosure you request or authorize.
No mobile information (including phone numbers and SMS opt-in data) is shared with third parties or affiliates for their own marketing or promotional purposes.
6. Cookies and Similar Technologies
The Site does not run advertising trackers or third-party analytics cookies of its own. Our hosting provider may use technologies necessary to deliver and secure the Site. You can block or delete cookies and site data in your browser settings. The Site does not currently respond to browser "Do Not Track" signals, but we honor the Global Privacy Control signal as an opt-out of sale or sharing, even though we do not sell or share personal information.
7. SMS and Email Communications
You can opt in to text messages only by checking the optional SMS consent box on a Site form or on our opt-in page at thekreativebrands.com/sms. If you do, you consent to receive texts from Kreative Brands LLC at the number you provide, including follow-ups about your inquiry. Consent is not a condition of any purchase. Message frequency varies. Message and data rates may apply.
- Opt out: Reply STOP to any message at any time. You will receive one confirmation and no further texts.
- Help: Reply HELP or email info@thekreativebrands.com.
- Carriers are not liable for delayed or undelivered messages.
- Our SMS program is for individuals 18 or older.
Emails we send for business development include an unsubscribe option or a way to reply asking us to stop, and we honor requests promptly and within the time required by law.
8. Data Storage and International Transfers
Information is stored on systems operated by our service providers, primarily in the United States. If you access the Site from outside the United States, your information will be transferred to and processed in the United States, which may have different data-protection laws than your country. Where required, we rely on appropriate transfer safeguards such as standard contractual clauses offered by our providers.
9. Data Retention
- Inquiry and contact records that do not lead to a business relationship: generally up to 3 years from our last interaction, then deleted or de-identified.
- Records tied to a contract or ongoing relationship: for the life of the relationship plus the period required for tax, accounting, and legal purposes (generally up to 7 years).
- SMS consent and opt-out records: up to 5 years, so we can demonstrate compliance and honor opt-outs.
- Server and security logs: generally 30 to 90 days, unless needed to investigate an incident.
We may keep information longer when required by law or needed to resolve disputes or enforce our agreements.
10. Security
We use reasonable administrative, technical, and physical safeguards appropriate to the sensitivity of the information, including encrypted (HTTPS) transmission, access limited to people who need it, credential-based access controls on our business systems, and vendor selection that considers security practices. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If a breach affects your personal information, we will notify you and regulators as required by applicable law.
11. Your Privacy Rights
Depending on where you live, you may have the right to:
- Know and access the personal information we hold about you and receive a portable copy.
- Correct inaccurate information.
- Delete your information, subject to legal exceptions.
- Opt out of the sale or sharing of personal information and of targeted advertising or profiling. We do not engage in these activities.
- Limit the use of sensitive personal information. We do not use it beyond what is needed to respond to you.
- Restrict or object to certain processing, and withdraw consent at any time.
- Not be discriminated against for exercising your rights.
- Lodge a complaint with your data protection authority or state attorney general.
To exercise a right, email info@thekreativebrands.com with the subject line "Privacy Request," or call the number below. We will verify your identity by matching details you give us to the information we hold. We respond within 45 days (or sooner where the law requires), and may extend once by another 45 days with notice. You may use an authorized agent, and we may require proof of authorization. If we deny a request, you may appeal by replying with the word "Appeal," and we will respond within 60 days. If your request concerns data we hold for a specific brand, we may direct you to that brand.
